Acceptance Policy

1. General conditions

 1.1 It is forbidden to publish on the servers of the provider any content or links to such content that: (i) violates or prejudices in any way the intellectual property rights of other persons or other rights; (ii) have adult or pornographic or violent content; (iii) have defamatory or libelous content; (iv) have racial or discriminatory content; (v) contain viruses, Trojan horses or the like; (vi) contain pirated software or address to software piracy or other similar activities. Violation of these provisions is considered a violation of the “Acceptance Policy” resulting in immediate termination without prior notice and without the possibility of partial or total repayment of the contracted amounts and the customer’s account.

1.2 Beneficiaries of “shared” hosting packages do not have the right to store content other than their own site files and emails associated with their account on Host Expert servers. The storage space provided by Host Expert can only be used to store site and mail files. The Provider has the right to delete files that do not fall under such limitations in all situations where the user violates these provisions without further formalities, without notice and without being liable to pay damages to the user. Violation of these provisions is considered a violation of the “Acceptance Policy” resulting in immediate termination without prior notice and without the possibility of partial or total repayment of the contracted amounts and the customer’s account.

1.3 Use in any way of Host Expert services for any illegal or unlawful activity, including, but not limited to, credit card fraud, theft, threats or violence, as well as any attempt to undermine or cause harm to a Host Expert server or a Host Expert client is prohibited and is considered a violation of the “Acceptance Policy” that leads to immediate termination of the client’s account without prior notice and without the possibility of partial or total repayment of the contracted amounts.

1.4 Defamation, offense, or injury by any means to the Host Expert, any employee, customer, supplier or partner of the Host Expert is considered to be a breach of the “Acceptance Policy” that leads to immediate termination of the account, without prior notice and without the possibility of partial or total repayment of the contracted amounts.

 

2. VDS Limitations

2.1 Excessive use of the resources allocated to any VDS (abuse of resources by generating sustained or excessive consumption in accordance with 2.2) entails customer notification by Host Expert technical staff to optimize service or upgrade.

2.2 Resource abuse means the following: generating a load greater than twice the number of cores allocated for 15 minutes; consuming more than 1,000,000 (one million) inodes; generating more than 200 simultaneous processes over a period of more than 10 minutes; sustained use of I/O routes; use of more than 20 sockets.

2.3 The failure to optimize current services and the customer’s refusal to comply with the VDS service usage rules necessary for the proper functioning of Host Expert nodes is considered a violation of the “Acceptance Policy” leading to termination of the client’s account with one day notice and the possibility of partial or total repayment of the contracted amounts. This is at the discretion of the Host Expert.

 

3. Dedicated server constraints and collocation 

3.1 Bringing into the collocation space contracted by Host Expert any materials (e.g. liquids, explosives, firearms, jamming systems, etc.) that may cause harm or damage in any form to Host Expert, customers, staff, suppliers, partners or equipment existing in the collocation space is strictly prohibited and is considered a violation of the “Acceptance Policy” leading to immediate termination without prior notice of the client’s account and without the possibility of partial or total repayment of the contracted amounts.

3.2 Images used on the site for product presentation are informative and do not create contractual obligations.

3.3 Any damage of any kind to any other client, vendor, partner, or equipment existing in the collocation space is considered a violation of the “Acceptance Policy” resulting in immediate termination without prior notice of the customer’s account and without the possibility of partial or total repayment of the contracted amounts.

 

4. Web Hosting and Resource Limitations

4.1 For all web hosting accounts, the following are prohibited:

  • Using more than 15 minutes of more than 10% of the hosting server resources. In this regard, Host Expert may apply manual or automatic limitations or suspend the customer as appropriate.
  • Use of web hosting for public or private file hosting. Web hosting accounts can only be used to host the related site files.
  • Using the web hosting account to run applications (or store data) like: web spider, IRC, any P2P data (for example, torrent), real-time games, proxy.
  • Using the web hosting account to store more than 100,000 files (inodes).

 

4.2 Host Expert reserves the right to apply to any web hosting account any limitations it deems appropriate in order to ensure the proper functioning of the hosting servers and to protect customers from possible performance degradation.

4.3 In the case of computer attacks, Host Expert reserves the right to partially or totally modify customer hosted data to protect shared servers. This includes and is not limited to completing without notice the customer’s account.

4.4 In case of migrating sites and applications from another Host Expert server, it assumes no responsibility for the integrity, consistency and/or partial or total compliance of the data migrated to our servers.

 

5. Backup 

5.1 Host Expert offers customers the possibility to back up their active data according to the service they ordered.

5.2 Host Expert will make every effort to ensure the highest possible quality standard with regard to the integrity of data on its own backup servers, but it does not provide any guarantee at any time, as this is an additional service with a preventative role. For this reason, customers are strongly advised for maximum security to periodically make at least one backup on their own systems.
